RED FLAGS RULE EXTENDED AGAIN - 07/01/2010
As many in the dental industry expected, the Federal Trade Commission (FTC) announced on Friday (May 28th) that it is delaying enforcement of the Red Flags Identity Theft Rule once again. The new “tentative” compliance deadline is January 1, 2011. The purpose of the delay is to allow Congress more time to fix the unintended consequences of the legislation by limiting the scope of businesses covered by the Red Flags Rule. The ADA is expecting Congress to exclude dentists from the Red Flags Rule and the substantial fines and penalties for those who fail to comply. The January 1, 2011 deadline is considered tentative because the FTC announced, “If Congress passes legislation limiting the scope of the Red Flags Rule earlier than December 31, 2010, the Commission will begin enforcement as of that date."

Compliance involves developing written policies and procedures to prevent, identify, mitigate, and report identity theft. Even if dentists are excluded, risk liability carriers recommend that dentists voluntarily comply to reduce the risk of civil suits that may arise if adequate safeguards are not in place to protect patients’ confidential account information.
